Fig Thyme & Olive LLC

Last updated: July 13, 2026

These Terms and Conditions, referred to as the "Terms," govern your use of the Fig Thyme & Olive websites and your purchase or use of our products and services. These Terms apply to figthymeandolive.com, shop.figthymeandolive.com, quote requests, online orders, catering orders, charcuterie boards and boxes, grazing tables, delivery and pickup services, and related communications and customer services. By using our websites, requesting a quote, submitting an order, making a payment, or accepting an order confirmation, you agree to these Terms.

1. Business Information

Fig Thyme & Olive LLC provides handcrafted charcuterie products, boxes, boards, platters, grazing tables, catering items, specialty food products, delivery, and related services. References to "Fig Thyme & Olive," "we," "us," and "our" mean Fig Thyme & Olive LLC.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order.

By placing an order, you represent that:

  • The information you provide is accurate
  • You are authorized to use the selected payment method
  • You have authority to place the order
  • You have reviewed all applicable order details

3. Product Descriptions and Availability

We attempt to describe and display products accurately. However:

  • Colors and appearance may vary
  • Product arrangements may differ from photographs
  • Ingredients may vary by season and availability
  • Handmade products will not be identical
  • Serving-size estimates are approximate
  • Photographs are illustrative and may show optional items
  • Products, ingredients, packaging, and pricing may change

All products and services are subject to availability. We may limit quantities, discontinue products, substitute ingredients, or reject an order when necessary.

4. Quotes and Order Acceptance

Submitting an inquiry, quote request, shopping cart, or order form does not automatically guarantee acceptance. An order is accepted when we provide confirmation, approve the requested date, and receive any required payment or deposit.

We may decline or cancel an order because of:

  • Product or ingredient unavailability
  • Scheduling limitations
  • Delivery limitations
  • Incorrect pricing
  • Suspected fraud
  • Payment failure
  • Safety concerns
  • Errors in the order information
  • Circumstances outside our reasonable control

If we cancel an accepted order and no substitute is agreed upon, we will refund the amount paid for the canceled portion.

5. Custom Orders

Many products are prepared specifically for a customer, event, date, dietary request, or serving size. You are responsible for reviewing:

  • Product selection
  • Quantity
  • Event date
  • Pickup or delivery time
  • Delivery address
  • Recipient information
  • Dietary requests
  • Allergy information
  • Personalization
  • Special instructions

Changes are not guaranteed after an order has been accepted or preparation has begun. Additional charges may apply to requested changes.

6. Ingredient Substitutions

Ingredient availability may change because of seasonality, quality, supplier availability, or other circumstances. We may make reasonable substitutions of similar quality and value. We will attempt to communicate significant substitutions when practical. A requested ingredient is not guaranteed unless confirmed in writing.

7. Prices, Taxes, and Fees

Prices are shown in U.S. dollars. Applicable charges may include:

  • Product prices
  • Customization fees
  • Delivery fees
  • Mileage fees
  • Setup fees
  • Catering fees
  • Service fees
  • Rush-order fees
  • Taxes
  • Gratuities, when selected

Delivery and event-service pricing may vary based on distance, order size, timing, setup requirements, and venue conditions.

We may correct pricing errors before accepting an order. If an error is discovered after payment, we may offer the corrected price or issue a refund.

8. Payment

Payment or a deposit may be required to reserve an order date. You authorize us and our payment providers to charge the payment method submitted for order totals, approved additions, applicable taxes, delivery fees, and other disclosed charges.

An order may be delayed or canceled if payment cannot be processed.

You agree not to initiate an improper chargeback for a valid charge. Contact us first so we can attempt to resolve the matter.

9. Cancellations, Changes, and Refunds

Our products are perishable and are often purchased or prepared specifically for an individual order. Unless a different written cancellation policy is included in your quote or order confirmation:

  • Contact us as soon as possible to request a cancellation or change
  • A requested cancellation or change is not guaranteed
  • Orders may become nonrefundable after ingredients or supplies have been purchased or preparation has begun
  • Deposits may be nonrefundable when they reserve a date or cover nonrecoverable costs
  • Approved refunds may be reduced by payment-processing fees, custom expenses, purchased ingredients, or work already completed
  • No refund is required for an order that was prepared correctly but not picked up, accepted, or consumed
  • No refund is required because of personal taste preferences when the order materially matches its description
  • Any approved refund will generally be returned to the original payment method

A specific quote, invoice, event agreement, or order confirmation may contain different cancellation terms. Those written terms will control for that order.

10. Pickup

You are responsible for arriving at the confirmed pickup location and time. Because products are perishable:

  • Pickup times should be followed carefully
  • Delayed pickup may affect freshness, appearance, or food safety
  • We are not responsible for deterioration caused by late pickup
  • Orders not collected within a reasonable period may be discarded without refund

Inspect the order at pickup and notify us promptly of any visible issue.

11. Delivery

Delivery availability, timing, and fees depend on location and order requirements. You are responsible for providing a complete and accurate address, gate/building/floor/access instructions, a working telephone number, an available recipient, and a safe delivery location.

Delivery times are estimates and may be affected by traffic, weather, road conditions, venue access, or other circumstances.

An order may be considered delivered when:

  • It is handed to the customer or recipient
  • It is delivered to an authorized person
  • It is left at the agreed location
  • A delivery attempt is made but access or recipient availability prevents completion

Additional charges may apply for redelivery, extended waiting time, incorrect addresses, or failed delivery caused by customer-provided information.

12. Food Safety and Storage

Our products may include perishable meats, cheeses, fruits, spreads, and other ingredients. Customers are responsible for refrigerating products promptly, following provided storage instructions, maintaining appropriate temperatures, protecting food from contamination, serving and consuming food within a safe period, and discarding products that have been left unrefrigerated for an unsafe amount of time.

We are not responsible for illness, spoilage, or deterioration caused by improper handling, delayed pickup, delayed consumption, unsafe storage, weather exposure, or conditions occurring after delivery or pickup.

13. Allergies and Dietary Requests

Fig Thyme & Olive is not an allergen-free facility. Products may contain or come into contact with milk, eggs, wheat or gluten, soy, peanuts, tree nuts, sesame, fish, shellfish, or other allergens. Products may also include cured meats, pork, alcohol-derived ingredients, sulfites, honey, or other ingredients that may conflict with dietary, religious, or medical restrictions.

Although we may attempt to accommodate a request, we cannot guarantee that:

  • An item is completely allergen-free
  • Cross-contact will not occur
  • Supplier labels are free of errors
  • Substituted ingredients will meet every restriction

You must notify us of allergies and restrictions before ordering.

Individuals with severe or life-threatening allergies should not rely on our products being free from cross-contact. Consult a qualified medical professional when necessary.

14. Grazing Tables and Event Services

For grazing tables, catering, or on-site services, the customer is responsible for:

  • Accurate guest counts
  • Venue authorization
  • Access to the event space
  • Adequate setup time
  • Suitable tables and surfaces unless otherwise agreed
  • Climate-controlled or weather-appropriate conditions
  • Timely refrigeration where required
  • Informing guests of known allergens
  • Preventing contamination after setup
  • Venue fees, permits, and restrictions

Additional fees may apply when event conditions differ from those originally disclosed.

15. Promotions and Discount Codes

Promotions and discount codes may have expiration dates, may be limited to specific products, may not be combined, may be limited to one use, have no cash value, and may be changed or withdrawn where legally permitted.

Discounts cannot be applied retroactively unless we agree otherwise.

16. Website Use

You may use our websites only for lawful personal or business purposes. You may not:

  • Attempt to gain unauthorized access
  • Interfere with website security

  • Submit fraudulent orders
  • Use stolen payment information
  • Harass staff or other users
  • Infringe intellectual-property rights
  • Use the website for unlawful activity

We may suspend access or reject orders associated with prohibited conduct.

17. Customer Content

You may submit reviews, photographs, feedback, comments, or other content. You represent that your content is accurate, is not unlawful or misleading, does not violate another person's rights, does not contain malicious code, and does not disclose another person's private information without permission.

You retain ownership of your original content. By voluntarily submitting content for publication or promotional use, you grant us a nonexclusive, worldwide, royalty-free license to display, reproduce, adapt, and promote that content in connection with our business.

Contact us if you want us to stop using submitted promotional content. Removal may not affect materials already printed or published.

18. Intellectual Property

Our website, branding, logo, photographs, product names, written content, graphics, designs, and arrangement are owned by or licensed to Fig Thyme & Olive and are protected by intellectual-property laws. You may not reproduce, sell, modify, distribute, or commercially use our content without written permission.

19. Third-Party Services

Our websites may use or link to third-party services, including payment processors, social-media platforms, maps, delivery services, and hosting providers. We are not responsible for third-party content, policies, availability, security, charges, performance, or products or services.

Your use of a third-party service may be governed by separate terms.

20. Disclaimer of Warranties

To the maximum extent permitted by law, our websites, products, and services are provided on an "as available" and "as is" basis. We disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and noninfringement, except where those warranties cannot legally be excluded. We do not guarantee uninterrupted website access or that every website error will be corrected immediately.

21. Limitation of Liability

To the maximum extent permitted by law, Fig Thyme & Olive LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages.

Our total liability arising from a particular order will not exceed the amount actually paid for that order.

These limitations do not apply to liability that cannot legally be limited, including liability resulting from fraud, intentional misconduct, or other conduct for which limitation is prohibited by law.

22. Indemnification

You agree to indemnify and hold harmless Fig Thyme & Olive LLC and its owners, employees, contractors, and representatives from claims, losses, liabilities, and reasonable expenses arising from:

  • Your violation of these Terms
  • Your misuse of our websites
  • Inaccurate information you provide
  • Your improper handling or storage of products
  • Your infringement of another person's rights
  • Conditions at an event or delivery location under your control

23. Events Outside Our Control

We are not responsible for delays or failure caused by circumstances beyond our reasonable control, including:

  • Severe weather
  • Natural disasters
  • Power outages
  • Supplier shortages
  • Transportation interruptions
  • Government actions
  • Public-health emergencies
  • Labor disruptions
  • Internet or payment-system failures
  • Venue restrictions
  • Illness or emergencies

We will attempt to communicate and provide reasonable alternatives when possible.

24. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Unless applicable law requires otherwise, legal proceedings arising from these Terms or our services must be brought in a state or federal court with jurisdiction over the North Carolina county in which Fig Thyme & Olive LLC maintains its principal place of business.

25. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

26. No Waiver

Our failure to enforce a provision does not waive our right to enforce it later.

27. Changes to These Terms

We may update these Terms periodically. The version posted when an order is accepted will generally govern that order unless the parties agree otherwise in writing.
